JIM MANZI, the chief executive of Lotus, received a fateful early- morning telephone call last Monday. On the line was Louis Gerstner, his counterpart at IBM, who said he wanted to warn Mr Manzi of what he was about to announce to the world: that he was going after Lotus with a $3.3bn (pounds 2bn) unsolicited bid. Mr Manzi, according to Lotus insiders, was “emotionally devastated” by the news. There are a multitude of reasons, however, why Mr Manzi must have quickly understood why resisting the bid was likely to be pointless and even perverse. By Tuesday night, he and Mr Gerstner were dining secretly together at a discreet midtown Manhattan restaurant to discuss making peace, while executives from both companies huddled on each of the next three days to ponder the implications of a merger. While, under US law, Lotus has until tomorrow week to respond to the bid, most analysts expect it to capitulate much sooner. First, there is the question of price. IBM is offering a lip-smacking $60 a share for Lotus, representing a premium of more than 100 per cent on the share price shortly before the bid. To seal the marriage, IBM is rumoured to be ready to offer more, perhaps $65. Lotuss first instinct was to seek out a white knight, with the help of Wall Street advisers Lazard Freres, to top the IBM bid. But while some names surfaced, notably Oracle and also ATT, with which Lotus already has an alliance, there was little expectation that either would have the cash or motivation to outbid Mr Gerstner. Any attempt simply to block IBMs advance would hardly endear Mr Manzi to his institutional shareholders, who hold more than 80 per cent of the Lotus stock.

It points out that vacancy rates for office space across Los Angeles County have gotten quite low. As a result, it said, already high rents appear headed up even more. NEW YORK — Altering both the Federal Family Education Loan Program and Higher Education Act of 1965 may expose the U.S. student loan asset-backed securities sector to credit risk, according to Fitch Ratings. While most of the proposed changes to FFELP and HEA would actually have little to no bearing on student loan ABS collateral, some, such as allowing for loan reconsolidation and offering extended repayment terms, would have a more dramatic effect, said David Hartung, Senior Director, Fitch Ratings. The budget proposal is clearly focused on cost cutting, and the question of who will bear the burden of that is one that will be debated extensively over the next several months. While borrowers currently have limited opportunity to reconsolidate their loans, the new budget would allow for unlimited reconsolidation with a 1% loan origination fee per reconsolidation, a change that may adversely affect student loan ABS if the proposal is not limited to future new loan consolidation loans. Additionally, a proposal to prospectively reduce guaranty agency insurance and government reinsurance may increase Fitchs expected loss assumptions for student loan ABS going forward.

THE CYCLING COLUMN After paying a visit to Europes only cycling ergonomics centre, Cyclefit, at the end of November, I found myself referred on to a specialist sports physiotherapy clinic, Balance in south London, due to some niggles I was suffering from in my left knee. My hour at Balance last week was in many ways similar to my morning at Cyclefit, as I found myself being filmed on my bike and on the treadmill. But this time, the focus was more on the movement of my knees and pelvis, and whether I was keeping these in straight lines, as I should be.
The section of abbreviations serves to highlight the point that these will vary from country to country and to recognize the need for accuracy in order to prevent errors or misinterpretation. The chapters proceed very logically from basic science to the recognition and handling of patients with complications and comorbiditys. Emphasis is placed on the hip, knee, shoulder and foot/ankle. Very limited coverage for spine surgery patients is noted and post amputation physiotherapy is absent in this first edition. The comprehensive Index leads readers to the text quite readily. Economics and cost factors have been considered as pertains, for example, to the use of autologous blood transfusions, pressure sore prevention, care maps critical pathways, and the need for specific strategies for early discharged patients. A few of the named medications may not be found in USA formularies or the Physicians Desk Reference. Patient education is thoroughly discussed; but not the potential use of the Internet, diagnosis related support groups and bilingual materials. Without reservation, this book is recommended for physiotherapists and others who have the responsiblity of caring for orthopaedic patients of all ages and with a wide variety of conditions. Quality rehabilitation management has military implications, especially during worldwide engagements with multinational forces in support.
Publication of randomised trials and systematic reviews in physiotherapy has increased spectacularly over the past few years. There are more than 2700 randomised trials and systematic reviews in physiotherapy, of which more than 800 have been published since 1997.[1] The evidence from the best of these trials confirms the value of some current physiotherapy practices and the ineffectiveness of others. Some little used interventions have been found to be remarkably beneficial. This article describes some advances in our understanding of physiotherapy that have arisen from recent clinical trials. With the help of several organisations and many volunteers, we have produced a web based database of randomised trials and systematic reviews in physiotherapy (PEDro).[1] Trials on the database are rated for methodological quality by using a modification of the Delphi list.[2] To produce this article, we scanned the database looking for recent systematic reviews or high quality clinical trials with clear conclusions and with potential to improve quality of life. We present selected findings of these trials and reviews.

Medications identified as pharmacotherapies for alcoholism were the focus of the review. These pharmacotherapies included the opiate antagonists naltrexone and nalmefene, along with disulfiram, acamprosate, lithium, and various serotonergic drugs, including the selective serotonin reuptake inhibitors (SSRIs). The efficacy of each agent or class of agents in reducing the number of drinks ingested, the number of days on which a drink was consumed, the resumption of drinking and episodes of heavy drinking and craving were evaluated. Information about study design and sample size, as well as other study criteria, was collected. The overall strength of the evidence was based on a comparison of information across all studies abstracted. A total of 41 studies were abstracted, and the data analyzed. Of these studies, 11 evaluated disulfiram, three naltrexone, nine acamprosate, 12 the SSRIs and six lithium. The data on oral disulfiram (200 to 250 mg per day) provided modest evidence of a reduction in drinking frequency, but no improvement in abstinence rates. The data on disulfiram implants were inconclusive. Oral naltrexone (50 mg per day) appeared to reduce drinking frequency and relapse rates but only when used in combination with supportive psychotherapy. The rate of heavy drinking also diminished, as did the reported high associated with alcohol consumption. Nalmefene (10 to 40 mg per day) reduced heavy drinking and relapse rates, but these results were based on a small sample size. Acamprosate (1,300 to 2,000 mg per day) increased the number of reported nondrinking days from 30 to 50 percent. Abstinence rates also increased, an effect that seemed to last after study completion. The SSRIs studied, including fluoxetine, buspirone citalopram and ondansetron, appeared to have no major effect on the outcomes studied. However, in depressed alcohol-dependent patients, fluoxetine was associated with decreases in the amount and frequency of drinking. Studies of patients taking lithium found that this drug was no more effective than placebo in treating alcoholism. The authors conclude that some of the traditional medications used for treatment of alcoholism appear to be less effective than was previously thought and perhaps should be used less frequently. Evidence about the efficacy of disulfiram is inconclusive; it appears to reduce the number of drinking days but is associated with negative evidence on other outcome measures. The authors also emphasize that preliminary evidence tends to support the use of naltrexone and acamprosate, but these agents require additional study. Many questions about the use of pharmacologic agents for treatment of alcoholism remain. What combination of psychosocial intervention and medication is best? What synergistic effects are possible with the use of more than one medication? What is the optimal duration of therapy with each medication? Future research on optimal pharmacotherapy is needed. One thing is certain: psychosocial factors must be addressed before patients can move from addiction to sobriety.
Alcohol use is associated with a wide range of drinking behaviors, some of them relatively benign.[1] In a broad spectrum of patients, however, drinking has recurrent and significant adverse consequences ranging from mild problem drinking to severe alcoholism.[2] The medical, social and economic consequences of alcohol abuse can be devastating. Heavy drinking is associated with increased, as well as premature, mortality. The financial cost to society is also burdensome. In 1993, expenses associated with alcohol abuse were estimated to be $85.8 billion, including treatment costs, productivity losses and accident costs.[1] The majority of Americans visit their primary care physician at least once a year.[3] Since an estimated 25 percent of Americans are either problem drinkers or alcoholics,[4] the primary care physician is clearly in a unique position to detect and address alcohol-related issues and, in fact, may be be the first point of intervention.

The Utah Supreme Court has reversed the felony conviction of a DUI offender, saying the man did not have the two misdemeanor DUI convictions within a 10-year-period needed to qualify him for a felony charge. Steve Pettengill, of the United States, sailed into Charleston, South Carolina yesterday to take second place in the 27,000-mile BOC Challenge. Pettengill, sailing Hunters Child, completed the voyage in 128 days, four hours, three minutes and nine seconds. The Frenchman, Christophe Auguin, won in 121 days, 17 hours, 11 minutes and 46 seconds.
With gusts of over 30 knots blasting over the Holy Loch, several dinghy sailors found it nigh on impossible to get their boats righted in the difficult conditions. In the slow dinghy class, Strathclyde Loch Sailing Clubs Crawford Reid produced two firsts in his Albacore, putting him out in front as a clear leader in the 13-strong class and Alan Milton in Pepsi took two more decisive wins in the Sigma 33 class. Cove Sailing Clubs Alan Harper in Pied Piper sealed a championship win with a second and fourth, while Clyde Cruising Clubs Donald Sharp had two good wins and lifted the IRC Class 2 crown.

Customers throughout the Oklahoma region have contributed substantially to the skyrocketing trend of using Caller ID, which now has more than 3 million subscribers in Southwestern Bells traditional five-state service territory. Nearly one out of three Southwestern Bell residential customers in Oklahoma, Texas, Missouri, Arkansas and Kansas subscribe to Caller ID, enabling them to see the name and number of the person calling their home. Companywide, 32.25 percent of all residential customers subscribe to Caller ID, Doney said.
TELEPHONE users may think that because they have Caller ID service they know whos calling them. But they could be wrong. Caller ID spoofing, a subscription service available online that allows a caller to present a false originating number to the person he or she is calling, can thwart Caller ID. Some spoofing services even disguise the callers voice. Edwin Simonson, president of TeleDesign Security, said he has frequently had to help corporate clients who were victimized by Caller ID spoofing.

Yamaha Motor Co., Ltd. has announced that it will establish a new company in Hanoi, Vietnam, to produce engine parts for motorcycles. The new company, called Yamaha Motor Parts Manufacturing Vietnam Co., Ltd. (YPMV), will be capitalized at US$14.3 million (approx. 1.5 billion yen), and will be a 100% subsidiary of Yamaha Motor Co., Ltd. Yamaha Motor made the decision to establish Yamaha Motor Parts Manufacturing Vietnam in response to the dramatic increase in motorcycle production at Yamaha Motor Vietnam, as well as the increased production of die-cast parts within Japan.
Since 1997, AMS (Jefferson, WI) has produced shifter forks for Harley-Davidson motorcycles that run on the companys Twin Cam 88 engines. Founded in 1980 with a drill press in Ron and Sue Andersons house, AMS is now housed in a 40,000 ft^sup 2^ (3720 m^sup 2^) plant. The company employs more than 90 people and operates 43 machines. To produce the shifter forks, AMS uses a production cell consisting of three Makino (Mason, OH) ASSE horizontal machining centers managed by a Makino Machining Complex (MMC) and model A3 Cell Controller. The system, which replaced the companys initial shifter fork production process, has been running since November 2001. The Makino machines helped AMS drive costs out of their manufacturing process by redirecting 50% of labor while increasing production by 30%. AMS initially used four high-speed HMCs to produce the forks. Twelve operators ran the machines around the clock, five days per week. Although the process was effective, Anderson wanted a more efficient and economical way to produce the shifter forks. The company began by investigating more productive HMCs.

LAWYERS who had wanted General Pinochet extradited were still trying early last week to decide what “legal steps” they could take to stop him going to Chile. For some reason I found myself thinking of the sad advertisements one used to see occasionally in the personal columns: “Public school man seeks interesting job, anything legal considered.” But of course I was confusing two different functions of the word legal. Ethical began by meaning “to do with ethics”, and only later came to mean being good. The purist in me still winces when someone says “aesthetic” when they mean “in good taste”. (Aesthetic originally meant “to do with the science of perception”, then “to do with taste”, good, bad or indifferent.) But there was never any need for legal to carry two meanings, because theres a perfectly good alternative that takes half the burden off it: lawful, a nice old word from the late Middle Ages (its parent word, law, appears to be of ancient Scandinavian origin). Everyone understands the difference between “legal business” and the “lawful business” that most of us spend our lives going about. Why couldnt those job-seekers have put “anything lawful considered”? Lawyers use lawful, too; they speak of a “lawful killing”. They dont say “a legal killing” (which, if it meant anything, would presumably refer to their fees).
They argue that, if marijuana, cocaine, heroin, and other drugs were legalized, several positive things would probably occur: (1) drug prices would fall; (2) users would obtain their drugs at low, government-regulated prices, and they would no longer be forced to resort to crime in order to support their habits, (3) levels of drug-related crime, and particularly violent crime, would significantly decline, resulting in less crowded courts, jails, and prisons (this would allow law-enforcement personnel to focus their energies on the “real criminals” in society); and the drug production, distribution, and sale would no longer be controlled by organized crime, and thus such criminal syndicates as the Colombian cocaine “cartels,” the Jamaican “posses,” and the various “mafias” around the country and the world would be decapitalized, and the violence associated with drug distribution rivalries would be eliminated. By contrast, the anti-legalization camp argues that violent crime would not necessarily decline in a legalized drug market. In fact, there are three reasons why it might actually increase. First, removing the criminal sanctions against the possession and distribution of illegal drugs would make them more available and attractive and, hence, would create large numbers of new users. Second, an increase in use would lead to a greater number of dysfunctional addicts who could not support themselves, their habits, or their lifestyles through legitimate means. Hence crime would be their only alternative. Third, more users would mean more of the violence associated with the ingestion of drugs. These divergent points of view tend to persist because the relationships between drugs and crime are quite complex and because the possible outcomes of a legalized drug market are based primarily on speculation. However, it is possible, from a careful review of the existing empirical literature on drugs and violence, to make some educated inferences.

The Directorate of Health Promotion and Wellness (DHPW) at the U.S. Army Center for Health Promotion and Preventive Medicine was established in 1995 with the mission of integrating health promotion into the total Army. A dentist was assigned to the DHPW staff in 1996 to help integrate health promotion into the Army Dental Care System (ADCS). To guide the development of DHPW products, services, and policy for the ADCS, DHPW conducted a survey of dental health promotion and preventive dentistry practices within the ADCS. The survey queried the frequency with which dentists deliver such services and the type and source of their patient educational materials. In this paper, we report the findings of that survey and discuss their implications for improving the delivery of dental health promotion and preventive dentistry services in the ADCS.

WASHINGTON — Construction of new homes and apartments plunged by 17.6 percent in March, the biggest decline in 14 years and another possible indication that rising interest rates are beginning to take a toll on the economy. Meanwhile, wholesale inflation shot up 0.7 percent as energy prices soared. The Commerce Department reported Tuesday that builders started construction on new homes and apartments at a seasonally adjusted annual rate of 1.84 million units in March, down from 2.23 million units in February. “This is a bit of a shocker,” said David Seiders, chief economist for the National Association of Home Builders. “But I dont think this represents a fundamental downshift in the housing market. There were special factors behind it.”
Rebounding from a B-month low, total housing starts surged 5 percent, up from 1.54 million units in April to 1.96 million in May. Single-family starts were up 2.1 percent in May as well. The National Association of Home Builders reported increases in new home and apartment construction in May for three regions: West, up 15.8 percent; South, 8.5 percent; and Northeast, 1.7 percent.

OUTSOURCINGThe growth in outsourcing in recent years is partly the result of a general shift in business philosophy. Prior to the mid-1980s, many companies sought to acquire other companies and diversify their business interests in order to reduce risk. As more companies discovered that there were limited advantages to running a large group of unrelated businesses, however, many began to divest subsidiaries and refocus their efforts on one or a few closely related areas of business. Companies tried to identify or develop a core competence, a unique combination of experience and expertise that would provide a source of competitive advantage in a given industry. All aspects of the companys operations were aligned around the core competence, and any activities or functions that were not considered necessary to preserve it were then outsourced. Today, outsourcing is embraced by companies of all sizes and industry orientations. As analysts Tom Osmond commented in Employee Benefit News, many companies have decided that transactional and administrative functions are neither core competencies nor value-added activities. In fact, some companies are putting themselves at risk as a result of using outdated technology and not complying with government regulations. Vendors, by focusing on administration as part of their business model, provide better service enforced by contracts and service-level agreements.Successful outsourcing requires a strong understanding of the organizations capabilities and future direction. As William R. King explained in Information Systems Management, [d]ecisions regarding outsourcing significant functions are among the most strategic that can be made by an organization, because they address the basic organizational choice of the functions for which internal expertise is developed and nurtured and those for which such expertise is purchased. In the industrial centres of Milan and Turin drinking water was at the limits of what is acceptable. The only city whose water failed was Palermo, in Sicily, due to excessive nitrate pollution from agricultural chemicals.
A valve malfunction at a water treatment plant has cut off 60 percent of the water supply to the city of Fountain. Sunday, city workers went around town telling people to stop watering their lawns. A mandatory restriction on outside irrigation is in effect until 4 p.m. Tuesday. Until then, residents should use water only for drinking, cooking and bathing.

As your new president, I face a challenging task when it comes to speaking to you about school finance. Let me give you my dilemma. It is the end of the school year as I write this piece and I am reflecting on the uncertain state of school finances in coming months and what these financial challenges mean for us as school system leaders. You will share my frustration that as many as half the nations students may be directly shortchanged of the education they deserve, with the remainder not immune to the impact of belt tightening. As bad as that news is, last year at this time NCSL found 36 states with budget gaps. On the other hand, NCLB and IDEA could be funded retroactively, which would help make up for last years budget shortfalls that resulted from unfunded or underfunded mandates. If you are a school leader in one of the rare districts whose state legislature decided this summer to support quality education with adequate funding for all your schools, the future must look bright, so you can skip the remainder of this column. If youre not in that sunny camp, please continue and let me share my thoughts.

Not a day goes by without yet another article extolling the virtues of the Internet. An estimated 30 million worldwide users to date and more logging on every day. To the small business owner, the real question is, Where does the hype end and the reality begin? Is the Internet really a viable proposition for the traditional small business, normally constrained by lack of time, staff and money? 10 questions to ask yourself The best way to determine whether or not the Internet makes sense for your business is to apply a simple “yes” or “no” answer to 10 important marketing questions: 1. Do my clients require specific product information before they can buy my product/service? 2. Do I spend a majority of my time selling the benefits of my product only to be asked, “Can you send me more information?” 3. Is my long-distance phone bill more than $100 per month? 4. Have I lost business as a result of playing phone tag with a potential customer because I was unable to “sieze the moment?” 5. Would a new employee handling sales paperwork free me to increase my companys revenues? 6. Is there an international market for my product? 7. Does my product have a story to tell? 8. Am I spending more than 20 percent of every dollar I make on marketing-related expenses? 9. Would instant customer feedback benefit my business? 10. Would the ability to capture orders 24 hours a day, 365 days a year, help my business? If you answered “yes” to just one of these questions, you should at least explore the possibilities that Internet commerce can offer. If you answered “yes” to five or more, you should dedicate some serious time and resources to finding out how the Internet actually works (and how it can work for you). If you answered “yes” to eight or more of the questions, you need a fast-track education about the Internet before your competitors claim the medium for themselves. The smart small business owner will make plans to explore the Internet, find out what the Web can deliver and then formulate a strategy to exploit it. As Jeff Vick, Marketing Specialist at Creative Video explains, “The Internet will do to business in the 21st century what the telephone did to business in the 20th century.” The Web — How does it work? According to Vick, the Internet works well as a commercial sales tool for businesses that need to exchange information in order to specify a particular products size, color, model, price, etc. Multiple orders can be booked, billed and fulfilled through a simple response mechanism included on an Internet site. Much of this information can be communicated through the Web. While it is actually only one portion of the Internet, the Web serves as an extensive reference library that can provide any level of additional information about a particular subject, issue, item or product. As in a spiders web configuration, the Web provides an ever-increasing source of interlocking information about the subject in question. Simply point and click and you can dive deeper into additional layers of information. The Web also has certain features that make it ideal for marketing. It can display pictures and massive amounts of text about your product as well as send and receive order information while at the same time generating a receipt. If your product requires a lengthy explanation in order to communicate its benefits, the Web is the place to do it. Customers and prospects can view that information at their own pace — in many instances, via sophisticated video and audio commercials. Since were talking digital information here, there is very little difference between one word and one thousand words. And if you feel that youre spending too much time processing paperwork and not enough time selling, a well-designed Web page may be one of the potential keys to your businesses future success. How important is e-mail? An important byproduct of the Internet is e-mail, or electronic mail. Once you learn to use this valuable tool, youll wonder how you ever got along without it. Forget about what time it is, or whether its “worth a call” — with e-mail, it costs no more to send a message to Sydney that it does to Syracuse (the actual cost is about $1.00 an hour). And time zones become irrelevant as well. You and the recipient can view the messages at your convenience, thereby eliminating the dreaded game of telephone tag. So get serious! How does the smart business operator approach the formidable and intimidating task of investigating the Net? First, gather your thoughts as to what you would like your Web site to accomplish. Imagine that your customer can ask you anything he/she wants to know about your company and product — anything from product price to employee birthdays — and in no particular order. Analyze each possible scenario and list all the information relevant to it. Then, and only then, begin to organize the scenarios into a flow chart. Once you have the flow chart polished, try to find flaws in it. If your customer is browsing through the pricing section of your flow chart, will he/she be more interested in going to shipping next or reading your companys mission statement? After you feel that youve developed a solid grasp of the different portions of the business that youd like to present to your clientele, you are now ready to interview potential agencies who are skilled in creating Web pages. According to Vick, there are 3 questions you should ask a potential Web page creator: 1. Have you done this before? 2. Who have you done this for? 3. May I call them? While creating some Web pages may require the skills of a computer Ph.D., most will not, and there are competent companies in most major markets capable of accomplishing the task in a cost-effective fashion. Prices for creating a simple Web site can range from a low of $2,500 to high of $20,000. In fact, some of the Fortune 500 marketers have created sophisticated and complex Web pages that can literally run into the hundreds of thousands of dollars, and in some cases, the millions. But for the average small business, the investment will probably be in the $5,000 to $10,000 range. And remember, you must keep your Web site content fresh, or your prospects will have no reason to come back. Seeing your own World Wide Web site up and running on the Internet can be a proud moment for any business owner. It also can mean the start of a whole new way of doing business. It has the potential to increase productivity by extending operating time to a full 24 hours a day. But this will only happen if your business really needs this technology and can use it effectively. Evaluate your situation honestly. If its right for you, acquire it. If its not, save the money. And if you want to see what its all about, contact a Web creator and ask to see a demonstration. The hope is that future research will lead to the development of laser cooling devices for space, possibly to cool spacecraft instruments. Simply put, the intention of this legal reform is to simplify the law and to improve accessibility for all by streamlining procedures in response to the public. Alberta Justice, through its Family Law Reform Project, initiated a review of all provincial family laws following a series of public consultations, primarily in Edmonton and Calgary. Family law problems are inherently complicated and in Alberta, in addition to legal issues, procedural issues–both systemic and jurisdictional–have long frustrated efforts to resolve cases. Some family law problems, such as divorce, spousal support, and child support, are matters of federal jurisdiction, governed by the laws of Canada. Others, such as the division of matrimonial property and custody or access orders in non-divorce or common-law situations, are said to be matters of local and provincial concern and are governed by provincial laws. While legislative jurisdiction is a topic that does not really interest anyone other than lawyers, it is something that, in Alberta at least, has confused and frustrated members of the public, since it determines which court deals with which issues. As a rule, matters arising from federal statutes must be dealt with in courts of superior jurisdiction–in Alberta, this is the Court of Queens Bench–while matters arising from provincial legislation are generally, but not exclusively, matters for the lower level provincial courts. For years, the public has had difficulty determining which court is the appropriate court for a particular problem. In addition, there has been significant concern in the past over jurisdictional abuses, including forum shopping and the unnecessary duplication of proceedings in both levels of court. Sometimes this occurs at the initiative of lawyers themselves, but it is also common on the express instruction of clients. Clients unhappy with a lower court decision may want a second kick at the can in the higher level court. Applying for the same or similar relief in a higher level court is a de facto appeal of the lower level decision, without meeting the formal requirements for an appeal in law. While members of the Alberta judiciary frown on it, whether at the behest of lawyers or clients, such conduct has been frustrating to contend with over the years.
How does it work? Lets compare it with a typical scenario. Mom and Dad are getting a divorce, and they cant agree on anything. Each of them goes to a lawyer to find out what their rights and obligations are. First, the lawyers explain the law, and then send them to mediation to see what they can settle. Mediation is unsuccessful, and the parents go back to the lawyers. Second, the lawyers try negotiating between themselves, but still cant resolve the issues. So, the lawyers launch into the third stage — the litigation process. They hold examinations for discovery and may bring interim court applications. Both sides may hire experts to support their positions. They line up the witnesses, and everyone heads down to the courthouse. There, a judge hears about the family for a few hours or a few days, and makes a decision everyone has to live with for the rest of their lives. The litigation process is expensive, time-consuming, and emotionally draining, with no guarantee that either party will be happy with the outcome. In CFL, the process stops short of the litigation stage — both parties and their lawyers sign a written contract confirming that none of them will go to court under any circumstances. They must negotiate their own settlement. Instead of using their resources to do battle against one another, they jointly hire a team of experts to help them solve their problems. Mom and Dad may meet with a therapist to help them put aside the emotional issues of the divorce. The therapist may work on improving their communication skills so that meetings are more productive. Mom and Dad may also hire a child specialist to identify their childrens needs, and help them build a parenting plan that meets those needs. Mom and Dad both agree to make full financial disclosure, and they may hire a financial planner to help them sort out the dollars and cents of their divorce. The financial planner might present budget alternatives, or present a range of financial planning alternatives. All these experts are neutral third parties and do not favour one side over the other. The lawyers serve several functions in the CFL process. They must make sure each client sticks to the contract and negotiates in good faith. For example, if one learns that his/her client is withholding information, he or she must advise the other side that the process is at an end (to preserve solicitor-client privilege, they reveal no details of the problem). The lawyers also supervise the process, and coordinate the joint hiring of the third party experts. They set the agenda for the four-way meetings with the other party. They familiarize themselves with their own clients needs and fears, and give him or her independent legal advice. When the process is successful, they write up the terms of the negotiated settlement.
Why do we concern ourselves with such things? The concept of the contract allows people to make commitments between themselves that the state will enforce–the result being future stability of relationships, avoidance of conflict, and general societal harmony. How odd, then, to apply these concepts to family law! It might fairly be said that the whole of family law concerns itself with addressing members of society where relationships are no longer stable, where conflict abounds, and where harmony has ceased to exist. The concept of family, I think, arises only in the context of some directly stated or some implied commitment. A husband promises to share his life with his wife. Beyond the formal commitment of marriage, separate or same-sex couples can likewise expressly, or by implication, promise to share their lives with their partners. Parents promise to care for and support their children. Each of these commitments could be said to be some form of express or implied commitment between people.

A recreational vehicle promises the comforts of ones own bed no matter where you are. Thorpe has spent many a night in an RV. At one time, he managed a dirt track racing team and traveled to 130 races a year. Even after he retired, he still spent his vacations on the road. Within a few weeks, he had outfitted his RV with stabilizing bars. The bars, now manufactured by Thorpe under the name Strong Arm Jack Stabilizer, attach to the underside of the RV and to the jacks that support the front of the trailer when its parked. The bars telescope out when the jacks are lowered, and then they are locked into place to form a set of rigid triangles.

At sea on our escort carrier we enjoyed watching flying fish as they leapt from the water, spread their wings and accelerated to flying speed by sculling with the bottom of their tails to remain airborne, skipping from wave to,wave. One day we saw a Navy pilot imitate a flying fish. We used to perch on a deck adjacent to the stern watching takeoffs. One day a pilot was launched at the wrong interval. As a result, he left the bow of the carrier as it pitched downward toward the sea. A moment later the bow rose, blanking our view of the plane and leaving us with sinking feelings as to the fate of the pilot. A few seconds later, when the bow dropped down, we saw the aircraft, practically on the tips of the waves, straining to gain a few more feet into the air. It looked just like a flying fish, bouncing from wave top to wave top. It did everything but wiggle its tail to get airborne! You can bet that pilot had plenty to say to the flight officer when he returned. Had he landed in the water, the ship would have run over him with virtually no chance of escape.

[ILLUSTRATION OMITTED] Its not that niche products dont have a broad appeal, noted Neil Donnenfeld, senior vice president of global sales and marketing for Advanced Vision Research, its just that broad audience is not yet aware of a potential solution. We have a product were marketing right now, SteriLid Eyelid Cleanser, which is a very good example of that, he said. Its the first product on the market to help treat blepharitis, a common condition that causes inflammation of the eyelids that impacts upward of 12 million people, as well as for use in both pre- and post-eye surgery. Blepharitis is a lifelong condition, and the only way to keep blepharitis from flaring is to initiate a daily eyelid cleansing routine, according to the National Eye Institute. Its a niche, Donnenfeld said, because a year into its launch SteriLid has generated $1.5 million in sales–small in comparison with other eye care products, but not so small when you consider that those are all incremental dollars. Thats the value of operating as a niche marketer, Donnenfeld said, identifying and developing products for conditions that may not have a satisfactory solution. According to Dr. Jochen, “The best candidates for this surgery are men and women who are in good physical health and have realistic expectations. Most of the blepharoplasty patients I see are age 35 or older, but if droopy or baggy eyelids run in the family, the patient may opt for surgery at a younger age.” Blepharoplasty generally is performed on an outpatient basis, under local anesthesia-which numbs the area round the eyes-along with oral or intravenous sedation. The procedure takes one to three hours. Dr. Jochen will make incisions that follow the eyelids natural lines, in the creases of the upper lids and just below the lashes in the lower lids. Through these incisions, he removes excess fat and trims any sagging skin and muscle. The incisions are closed with very fine sutures.
